Joel Bohmart has more than 40 years experience as a litigator in federal and state courts on the trial and appellate level in a wide variety of litigation matters.
A sampling of litigation matters is set forth below.
- Mr. Bohmart recently obtained a dismissal of a copyright and trademark infringement case on a motion for summary judgment in the United States District Court.
- He was successful in obtaining a reversal of a judgment in a copyright infringement case on appeal in the Second Circuit Court of Appeals resulting in the establishment of new law for international copyrights. He was trial and appellate counsel.
- Mr. Bohmart has represented plaintiffs and defendants in numerous trademark and intellectual property matters obtaining preliminary injunctions, and litigating opposition and cancellation proceedings before the Trademark Trial and Appeal Board.
- He was successful in obtaining a reversal of a judgment on appeal in real property litigation. Mr. Bohmart was appellate counsel.
- Mr. Bohmart was instrumental in defeating a motion for summary judgment on a breach of contract action involving the sale of real property.
- He was instrumental in obtaining a settlement for plaintiffs in class action securities litigation in the United States District Court and in obtaining a reasonable settlement for an underwriter in another action.
- He has represented plaintiffs and defendants in numerous contract, commercial and shareholder disputes, and has also provided consultation to companies, which are on the brink of bankruptcy and who later try to reorganize under the bankruptcy laws.
